1.Who we are

The website at https://hyrogames.com (the “Website”) is run by HYRO GAMES - FZCO (“HYRO GAMES”, “we”, “us”, “our”). We develop and publish our own games. Our address and email are in section 12.

These Terms of Service (“Terms”) are an agreement between you and us. They govern your use of the Website. By using the Website, you accept these Terms. If you do not accept them, please do not use the Website.

Our games have their own terms, which these Terms do not replace (section 5).

2.Using this website

The Website shows information about HYRO GAMES and our games, and has a contact form for sending us a message. It has no user accounts, sells nothing and shows no ads.

We give you a limited, non-exclusive, non-transferable and revocable permission to view and use the Website as these Terms allow. We keep every right that these Terms do not expressly give you. If you break these Terms, this permission ends, and we may take reasonable steps to stop you using the Website.

We may change, add or remove anything on the Website, or stop offering it, at any time.

3.Acceptable use

You agree not to:

• use the contact form to send spam, or bulk or automated messages;
• send us anything unlawful, threatening, abusive or deceptive, or pretend to be someone else;
• try to get around the Website's spam protection, or the limit on how many messages can be sent;
• interfere with, overload, probe or try to gain unauthorised access to the Website or the systems behind it, or get around any of its security measures;
• collect content from the Website by automated means, such as scraping, in a way that overloads the Website or harms how it works;
• use the Website in any way that breaks the law.

4.Our content

The Website and everything on it, including its text, design and pictures, the HYRO GAMES name, the Hyro mascot and the art from our games, are owned by us or our licensors and protected by copyright, trade mark and other intellectual property laws.

You may view the Website and share links to it. You may not copy, change, republish or sell our content, or use it in a way that suggests we sponsor or endorse you, except where the law allows you to.

If you believe something on the Website infringes your rights, email us at contact@hyrogames.com with enough detail to identify the material and your rights in it.

5.Our games

Our games are not played on the Website. They are played on platforms run by other companies, and the Website may link to them (section 6).

When you play one of our games, the terms of the platform you play it on apply, together with the game's own terms and privacy policy, which are available in the game or on its listing. These Terms do not cover playing our games.

6.Links to other sites

The Website links to websites and services run by other companies, such as the platforms where our games are played. We do not control them and are not responsible for their content, availability or practices. If you follow a link to one of them, you use it at your own risk and under that company's own terms and privacy policy.

7.Messages you send us

You can send us a message through the Website's contact form, or by email to contact@hyrogames.com. Messages sent through the form are emailed to our mailbox.

The form is protected by Cloudflare Turnstile, a spam check, and by a limit on how many messages can be sent in a short time. A message that fails these checks is not sent.

You are responsible for what you send us. You confirm that you have the right to send it and that it does not break section 3. If you send us feedback, suggestions or ideas, you agree that we may use them freely, without obligation, attribution or compensation to you.

Our Privacy Policy (https://hyrogames.com/privacy) explains how we handle the personal information in your message.

8.No warranties

To the fullest extent the law allows, the Website and everything on it are provided “as is” and “as available”, without any warranty, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not promise that the Website will be uninterrupted, secure or error-free, or that the information on it is complete, accurate or up to date.

Some countries do not allow these warranties to be excluded. There, this section applies only as far as the law allows, and your rights as a consumer are not affected.

9.Limitation of liability

To the fullest extent the law allows:

• we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits or data, arising from your use of the Website or your inability to use it;
• our total liability to you for all claims about the Website or these Terms is limited to 50 US dollars.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Nothing in these Terms affects any right you have as a consumer that cannot be excluded or limited by law.

10.Governing law and disputes

These Terms, and any dispute about them or about the Website, are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai.

Before starting formal proceedings, please contact us at contact@hyrogames.com so we can try to resolve the matter together. If it is not resolved within 60 days, it will be decided by the courts of Dubai, United Arab Emirates.

If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may also bring proceedings in the courts of that country.

If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce a part of these Terms, that does not mean we give up the right to enforce it later.

These Terms are written in English. If we provide a translation and it differs, the English version applies, unless the law requires otherwise.

11.Changes to these terms

We may update these Terms. When we do, we will change the “Last updated” date at the top. If a change is significant, we will also point it out on the Website. If you keep using the Website after a change takes effect, you accept the updated Terms. If you do not accept them, please stop using the Website.
